Sales and delivery conditions

These conditions apply to all quotations, sales and deliveries supplied by Specialcontainer.dk unless these are explicitly waived in writing.

Special purchase conditions or requirements by Buyer in, for example, Buyer’s order confirmation or in Buyer’s purchase conditions are not part of the agreement unless Specialcontainer.dk in writing has agreed to this.

 

  1. QUOTATIONS – AS SHOWN ONLINE OR OTHERWISE COMMUNICATED
    1.a All prices are excluding VAT.
    1.b All quotations are subject to prior sale.
    1.c For products shown on www.specialcontainer.dk prices and details are valid for as long as prices and details are shown on the website. In the time period before Buyer has ordered a product, it is the responsibility of Buyer to keep an eye on any changes in price, details, etc. On products beyond what is shown on www.specialcontainer.dk, quotations are binding for Specialcontainer.dk for 30 days from date of quotation.

     1.d Quotations only include the products and services that are explicitly mentioned in the quotations.

 

  1. PURCHASE ORDER
    2.a Products can be ordered on www.specialcontainer.dk in the webshop. If you have inquiries for products that are not shown on www.specialcontainer.dk, you are always able to contact Specialcontainer.dk by phone or email or chat.
    2.b The information given and descriptions and specifications on this website are for guidance only.
    2.c That products are shown on this website does not constitute an offer, but an invition to make an offer. A binding agreement is only concluded when Buyer receives an order confirmation or an invoice. Specialcontainer.dk is not responsible for typographical errors in prices, and all prices are subject to change. Any significant price change, is to be notified to Buyer immediately.
    2.d All agreements are as a standard point concluded in Danish.
    2.e Purchase orders are binding if the products are customized as per Buyer’s requirements.
    2.f Specialcontainer.dk is entitled to fully or partially letting work be carried out by a subcontractor.

 

  1. DELIVERY
    3.a All products are as a starting point with delivery terms EX Warehouse, unless otherwise stated in the description of the product, or otherwise agreed on or to be agreed on between Specialcontainer.dk and Buyer. Any postage and/or transport costs are to be agreed separately, and in the event that Buyer does not arrange pick-up from warehouse, these costs are to be settled by Buyer.
    3.b Delivery terms are according to Incoterms. In the event that Specialcontainer.dk is not able to deliver in due time due to circumstances which must be regarded as force majeure, the delivery time is postponed. Specialcontainer.dk shall in such case inform when delivery is expected to take place.
    3.c In the event of delivery delay, Specialcontainer.dk shall not be held responsible for indirect losses such as lost profits, production losses, damages or costs.
    3.d Specialcontainer.dk arranges delivery on all weekdays, with delivery usually within 3 business days for standard products available on stock. If the product is out of stock, delivery is arranged within the specified time in the description. Subject to any external circumstances at suppliers’ sides, which may delay delivery time.

 

  1. PAYMENT
    4.a Payment is due at the latest when products are sent and prior to products being released to Buyer.
    4.b For some customized products, Specialcontainer.dk may request a prepayment by Buyer. This should be agreed upon in the agreement between Buyer and Specialcontainer.dk.
    4.c Specialcontainer.dk accepts payment through bank transfer and with Dankort/VISA-Dankort, VISA, VISA Electron, Mastercard, JCB, UnionPay and American Express. If you pay by card, your card will be charged on the date your order is dispatched.
    4.d Specialcontainer.dk uses a secure payment system. Card payments are carried out in collaboration with ePay A/S, who encrypts all your card information with SSL (Secure Socket Layer) protocol. This means that it is not possible for outsiders to read your card information.
    4.e Buyer should be aware that when paying by credit card, the credit card company will often reserve the amount on your account, which will affect how much credit is left on the card.
    4.f Buyer is not entitled to withhold payments for any counterclaims , which have not been accepted by Specialcontainer.dk.
    4.g All amounts are in DKK (Danish Kroner) and are excluding VAT/”Moms”.

 

  1. TITLE/OWNERSHIP
    5.a The supply remains the property of Specialcontainer.dk untill full payment has been made.

 

  1. CONDITION OF PRODUCT
    6.a Products will be in a condition that is to be expected from images, photos, text, description, and other information provided in addition by Specialcontainer.dk.
    6.b Unless otherwise informed by Specialcontainer.dk, containers will be new, but will still have been transported for example on a one-way voyage trip on a container ship. There may be slight scratches after transport. Containers are sold as inspected by Buyer, or as could have been inspected by Buyer.

 

  1. COPYRIGHT
    7.a Copyright to drawings, documentation, and other information that Specialcontainer.dk has given Buyer access to, remains the property of Specialcontainer.dk.

 

  1. PRODUCT LIABILITY
    8.a For product lliability, the then-current rules of the chosen law applies. Specialcontainer.dk is not responsible for loss of earnings, consequential or other direct or indirect losses or expenses.
    8.b Specialcontainer.dk is not responsible for any damages caused by transportation beyond the stipulated delivery terms
    a) on third parties, buildings or movables, which occurs while the supply is at the Buyer’s responsibility and risk or resold to third parties,
    b) on products manufactured by the Buyer or to products incorporating the Buyer’s manufactured products, or for any damage to third parties, buildings or movables, which is caused by these products.
    8.c Buyer must indemnify Specialcontainer.dk in the case that that Specialcontainer.dk is held liable to a third party for damages or losses that Specialcontainer.dk under the above terms are not accountable.

 

  1. WARRANTY
    9.a Containers are guaranteed against any defects or omissions in construction, poor workmanship, or defective materials for a periode of 2 years. Any damages caused by mis-handling, mis-securing, mis-loading, impact and other natures of accident are excluded. The paint system is guaranteed against corrosion and/or paint failure for a period of 3 years and is based on ”RE 3” of the European degrees of rusting standards. Normal wear/tear, or corrosion caused by acid, alkaline solution or result from damage by abrasion impact or accident are excluded.
    9.b A 2 year warranty under the Danish Sale of Goods Act applies for private customers. Our warranty applies to defects in material and / or workmanship.
    9.c A 1 year warranty applies for business customers. Our warranty applies to defects in material and / or workmanship.
    9.d The claim does not apply to defects or damages committed by incorrect handling of the product / service.
    9.e In case of warranty issues, Specialcontainer.dk covers shipping costs to a reasonable extent.

    We do not accept packages sent on cash-on-delivery terms.
    9.g If a refund has been agreed, Buyer is to send their bank account details, so Specialcontainer.dk can transfer the agreed amount.

 

  1. RIGHT TO CANCELLATION – FOR PRIVATE CONSUMERS
    10.a We offer a 14-day full return policy on goods purchased from Specialcontainer.dk The 14-day period is counted from the day where Buyer receives the product. Return shipments are for Buyer’s expense.
    10.b Cancellation must be notified to Specialcontainer.dk within 14 days after the purchase and the product must be returned latest 14 days after cancellation has been notified to Specialcontainer.dk. The notification shall be made by e-mail to info@specialcontainer.dk. In the email, Buyer should clearly state that they wish to use their right to cancellation.
    10.c Regarding the condition of the product, when sent back by Buyer, the Buyer is only liable for any diminished value of the product vaue, which is due to other handling than what can be deemed necessary to establish the nature, characteristics and the way the product works. In other words – the product can be tried and tested in the same way as if it was tried and tested in a physical store. If the product is tried and tested beyond what is outlined above, Specialcontainer.dk will consider it as used, which means that by cancelling the purchase, Buyer will only get a refund for part or none of the purchase amount, depending on the product’s commercial value. In order to receive the entire purchase amount, Buyer is therefore allowed to try and test the product in the same way that you would be able to in a physical store. You can try and test the product, but you can not take it for actual use.
    10.d Please notice – Cancellation does not apply to business customers.

 

  1. COMPLAINTS – PRIVATE CONSUMER PURCHASES
    11.a If you have a complaint about a product, purchased from Specialcontainer.dk, you can send a complaint to:

    If you are a consumer residing in another EU country, you can specify your complaint in the EU online complaint platform, The Online Dispute Resolution (ODR). With ODR you are now able to complain directly to the webshop that you have been dealing with. This applies to webshops in all of Europe, and it is a simplification of the right to complain.   1. RIGHT TO CANCELLATION – FOR BUSINESS CUSTOMERS
    12.a Purchase orders can not be cancelled unless there is a written agreement about this between Buyer and Specialcontainer.dk.

 

  1. COMPLAINTS – BUSINESS TO BUSINESS – APPLICABLE LAW AND JURISDICTION
    13.a Any dispute arising between Specialcontainer.dk and Buyer shall be settled at a Danish court and according to Danish or International law.

 

  1. CONFIDENTIALITY
    14.a Specialcontainer.dk understands and respects the importance of privacy on the Internet. Specialcontainer.dk will not reveal Buyer / user information to any third parties unless it is necessary to implement a transaction. Specialcontainer.dk will not sell the name, address, e-mail address, credit card or personal data of Buyer / user to any third party without your prior permission.
    14.b For internal purposes and optimization of the website, your personal data might be collected by us or 3rd parties, such as Smartsupp.com, s.r.o., VAT ID CZ03668681.
